Probate Litigation and Will Contests
What are probate administration and will contests?
Sometimes things don’t go as planned. Disputes arise among family members that need to be settled through the courts. By filing the proper petitions and responses in the Probate Court, we can help you get a resolution to the problems that arise. Some of the questions that come up on a regular basis are:
- Is the appointed administrator or executor failing to do their job properly?
- Is the estate process taking too long?
- Is the administrator or executor stealing from the estate?
- Is the Last Will and Testament a forgery or was it obtained by fraud?
- Are relatives living in the property and refusing to leave?
- Have you been appointed as an executor or administrator and others are claiming you did something wrong?
- Is there a question about who are the legitimate heirs?
Can I handle the probate litigation on my own?
There are times when a lay person may be able to handle some uncontested matters on their own or with the limited advise of an attorney. Once a matter becomes contested, meaning there are opposing sides in court, I would NEVER recommend that a lay person try and handle it themselves. An attorney experienced in Probate Litigation should always be hired to help you if you are in one of the situations described above.
What if I don't think I can afford a lawyer?
We offer a number of options that will allow nearly anyone to be able to afford our help. For contested matters, we have payment plans, contingency fees and even custom plans just for you. The bottom line is that we can find a way to represent nearly everyone. Don’t wait because you think you can’t afford a lawyer.
